CONTRACT, RIGHTS, AND RESPONSIBILITIES
At EurekaUniversal.com, we will develop your “Web Page Package #4.”
Este CONTRATO DE PRESTACIÓN DE SERVICIOS se realiza entre el comprador mayor de edad en adelante EL CLIENTE, y GERSON GONZALEZ CORTES mayor de edad representante legal de www.eurekauniversal.com, en adelante EurekaUniversal.com ESTIPULACIONES FIRST CLAUSE – EurekaUniversal.com will provide THE CLIENT with the services outlined in Section I of this agreement and will deliver technical support for 12 months.
EurekaUniversal.com will follow the guidelines explicitly provided by the CLIENT to ensure the project meets their needs.
EurekaUniversal.com will operate independently from the CLIENT, adhering to industry standards and practices in its field of expertise.
SECOND CLAUSE This service provision does not constitute any employment relationship. EurekaUniversal.com assumes all costs associated with delivering the service, including social contributions and resources.
THIRD CLAUSE THE CLIENT is required to provide EurekaUniversal.com with all necessary materials to carry out the work, including texts, information, documents, audiovisual content, and any other elements required for the execution of the contracted service.
FOURTH CLAUSE The services and deliverables described in Section I of this agreement will be completed by EurekaUniversal.com within 30 business days following the initial payment of this agreement. A payment receipt will be sent to the buyer’s email, and the invoice will be issued once the payment has been completed.
FIFTH CLAUSEEurekaUniversal.com is committed to performing the contracted services professionally and meeting the completion dates agreed upon in this contract.
If employees or subcontractors are involved, they will follow EurekaUniversal.com’s instructions in alignment with its obligations under this agreement. EurekaUniversal.com ensures that all individuals involved will have the necessary qualifications and experience to carry out the agreed-upon tasks.
SIXTH CLAUSE
EurekaUniversal.com commits to keeping the CLIENT promptly informed of any incidents or actions that may arise during the provision of services.
SEVENTH CLAUSE.
If both parties deem it appropriate, this contract may be modified and/or extended as long as both agree and formalize it in writing through an annex to this contract.
EIGHTH CLAUSE: THE CLIENT is obligated to pay the agreed price for the contracted service.
NINTH CLAUSE: THE CLIENT must pay EurekaUniversal.com the full contract amount, and can do so using debit or credit card, any payment method accepted by PayU (our payment gateway), PayPal, bank transfer, or cash.
TENTH CLAUSE: EurekaUniversal.com will refund 100% of the payment if THE CLIENT is not satisfied with the work.
ELEVENTH CLAUSE: This contract may be terminated by either party in the following cases:
⦁ By mutual agreement.
⦁ Unilaterally, if one of the parties fails to meet the initial requirements of this agreement. In such cases, written notice must be provided, specifying the relevant details.
TWELFTH CLAUSE.
EurekaUniversal.com expressly waives any intellectual or industrial property rights that may arise as a result of this contract.
All work completed, including reports, designs, analyses, research, or any other documents or processes created during the execution of this agreement, will become the property of the CLIENT.
THIRTEENTH CLAUSE.
EurekaUniversal.com will perform daily backup copies during the hosting period. FOURTEENTH CLAUSE: Any payment is exempt from any withholding tax (ICA, Retefuente, or others), tax, surcharge, transfer fee, or commission for national or international bank transactions, depending on the case or country of origin. If any of these costs apply, they will be assumed by the client and added to the total payment to the agency.
